Town of Huron Planning Board Minutes - subject to approval.

Regular Meeting 6 October 2008 

 

Call to Order:  Larry Lockwood called the meeting to order on October 6, 2008 at 7:30 p.m.

 

Attendance:  Larry Lockwood, Jack McGuire, Chris Kenyon, Joe Snyder, Charles Boogaard

Other Officials Present:  Laurie Crane-Supervisor, Roger Gallant-Building Inspector and Dave Buisch- Councilman

 

Guests:  John Heckel, Bryan Klekota

 

Correspondence:  A letter from Councilmember David Buisch in regards to the resignation of Clerk to the Planning and Zoning Boards.
A packet to Chairman Lockwood from Genesee Transportation Council in regards to available grants.

 

Approval of Corrected Minutes: Chris Kenyon moved, seconded by Jack McGuire to approve the September minutes with the following correction - Joe Snyder acknowledged the corrections from David Buisch under Old Business of the Coastal Erosion, they were as follows: Joseph Snyder and David Buisch held a conference call with Attorney Knauf to discuss the different treatment of "non-major additions" to existing structures in coastal erosion areas by DEC regulations as compared to our coastal erosion law.  As a result of that discussion Alan Knauf drafted new language allowing "non-major additions" as a regulated activity subject to a Coastal Erosion Management Permit - removing the reference to open air decks and without making specific reference to the septic law; noting the Building Inspector is responsible to ensure all permitted activity complies with all town laws, including the septic law.  Joseph Snyder reiterated his opposition as he voted no to the new language and his comment why was, that given the likely septic issue on Crescent Beach he does not understand how the Town Board could consent to further residential expansion and make a negative declaration under the SEQR review. 

 

Old Business:
Coastal Erosion - The Town Board has set a hearing for Coastal Erosion Law on October 20, 2008 at 7:30 p.m.
Outdoor Furnaces - The Outdoor Furnace Law was referred back to the Planning Board at the September 15, 2008 Town Board Meeting.  A revised draft was received from Teeple/Gallant.
Outdoor Furnace Law Comments and Questions -

Joseph Snyder asked why the name of the law was changed from outdoor wood furnaces to outdoor furnaces.

Roger Gallant stated that there are more than outdoor wood furnaces, such as oil, corn  and coal burners.
Joe asked if the definition for outdoor furnace would eliminate an outdoor furnace from the law if it were solely used for heating their home.  Joe suggested in #5 Existing Outdoor Furnaces should have a specific period in time such as the date of the law. 
Joe feels that if a furnace is going to be registered it should be subject to no complaint on record.
Joe would like the existing furnace to comply with the stack requirements in 6 E.
Joe commented on permitted fuel, he would like to expand to say as specified by the manufacturer.
Under 6C. he feels it should state just 1 acre and strike out less with variance
Under 6D. he feels that setbacks for structures should also meet the property line set backs already in law plus not less than 100' from any residence.
Variances: Joe feels that if a variance is granted for less than the law requires it should not be allowed to operate for 12 months of the year.
Chris Kenyon remarked that the permitted fuel is vague. 
Charles Booggard referred to an ordinance that Central Boiler has established.
Larry Lockwood asked if we specify the stack height would this open us to a liability issue.
Roger Gallant asked how are the residents going to clean a high stack.
Bryan Klekota stated that the whole issue with the furnaces seems to be the smoke issue.
Supervisor Crane asked if manufacturers regulate how high the stacks should be.
John Heckel asked if we have had any complaints of outdoor furnaces and how many are in Town.
Roger guessed there are 15 to 20 furnaces in Town.  No complaints have been received.
Joe Snyder suggested that Charles Boogaard take the draft that Roger and Russ submitted and compare it with the Central Boiler Ordinance he has received and bring a comparison to the next meeting.  Joe also stated that if a variance is granted for an outdoor furnace it should be coupled to a reduced months of operation.

 

New Business:
County Planning Board - Larry stated that he attended the County meeting but there was nothing to report on Town of Huron.

 

Executive Session:

Chairman Lockwood moved to go into executive session for a personnel issue at 8:20 p.m.  Joe Snyder moved to go out of executive session at 8:45 p.m.

 

Adjournment & Next Regular Meeting
On motion of Jack McGuire, seconded by Chris Kenyon, the following motion was approved.  Moved that the meeting be adjourned at 8:45 p.m.
The next regular meeting will be held on Monday, November 3, 2008 at 7:30 p.m. at the Huron Town Hall.
