Meeting called to order at 7:00 p.m. by Vice Chairman Bob Lannon.

Welcome

Vice Chairman Bob Lannon welcomed everyone.

  

Roll Call      

Upon roll call the following members were present: Vice Chairman Bob Lannon, Tom Hamilton, Amy Connelly, David Fantuzzo, Gordon Smith and Jeff Simonet absent.

                 

Others Present:  Building Inspector Roger Gallant, Clerk Diane Bean. 

 

Guests:  Jennifer Harter & Daniel Dragos, Michele & Shawn Donegan, Kendra & Roger Tuttle, Don Lewis, Eli Bliss, Shelly Cahoon and Keith Smith.

  

Minutes:

A motion was made by Tom Hamilton, seconded by David Fantuzzo to approve the minutes of the December 8, 2020 meeting. 5 in favor, and Jeff Simonet absent.

New Application:


1032-21A: by Daniel Dragos & Jennifer Harter of Central Square, NY for the property at 9304 York Settlement Rd to build a 2 car garage. The Town of Huron Zoning Law Section 4.2.2.1 requirements in the A5A district need to comply with a minimum of 50 ft. side yard setback. 4.6.1.10 Pre-existing Non-Conforming Structure and 4.2.1.4 placement of garage on the front of the house unless granted a Variance by the Zoning Board of Appeals.

 

Gordon Smith moved, seconded by David Fantuzzo, that the Board find this request for Area Variance to be a Type II action of section 617.5 (c) (12) of SEQRA, having no significant environmental impact.

VOTE:       AYES: 5      NAYS: 0       ABSTAIN: 0       ABSENT: 1 

Jennifer Harter drew the Board's attention to the options included in their application: She informed the Board that they would prefer option A, which places the garage on the front of the house and existing driveway.

 

Bob Lannon asked if there was anybody here to speak on behalf of the applicant or in opposition of the application. There wasn’t anyone present.

 

 

Bob Lannon closed the public hearing: All in favor. 

All members inspected and/or are familiar with the site. Upon completion of Finding of Facts Tom Hamilton moved, seconded by David Fantuzzo to approve the application as submitted with option A which places garage on the east front side of house.

1033-21A by Michele & Shawn Donegan of Wolcott, NY for the property at 6503 Bonnie Castle Rd to add an addition to your cottage. The Town of Huron Zoning Law Section 4.2.2.1 requirements in the Resort district need to comply with a minimum of 75 ft. front yard, 10 ft. side yard and 25 ft. rear yard setbacks. 4.2.2.3 Coverage the maximum coverage in the Resort district shall be 20 percent unless granted a Variance by the Zoning Board of Appeals. 

Gordon Smith moved, seconded by David Fantuzzo, that the Board find this request for Area Variance to be a Type II action of section 617.5 (c) (17) of SEQRA, having no significant environmental impact.

VOTE:       AYES: 5      NAYS: 0       ABSTAIN: 0       ABSENT: 1 

Shawn Donegan advised the Board that he spoke with neighbors on both sides and they are good with what they are proposing to do.

 

Roger Gallant addressed the Board to make sure they realize that they need to make their decision based on the distance from the lot line and not the road as it states on the application.

 

Bob Lannon asked if there was anybody here to speak on behalf of the applicant or in opposition of the application. There wasn’t anyone present.

 

David Fantuzzo read the LWRP recommendation letter.

All members inspected and/or are familiar with the site. Upon completion of Finding of Facts Amy Connelly moved, seconded by David Fantuzzo to approve the application as submitted with maintaining the distance between the new addition and the lot line.

1034-21A: by Roger & Kendra Tuttle of Webster, NY for the property at 8320 Graves Point to build a new cottage and deck. The Town of Huron Zoning Law Sections 4.6.1.10 & 4.2.2.1 Schedule of Regulations requires any structure or building alteration, expansion or reconstruction to an existing non-conforming use shall not be allowed without a variance granted by the Zoning Board of Appeals. The Zoning Law also requires a minimum of 75 ft. front yard, 10 ft. side yard and 25 ft. rear yard setbacks in the resort district. 

Gordon Smith moved, seconded by Amy Connelly, that the Board find this request for Area Variance to be a Type II action of section 617.5 (c) (17) of SEQRA, having no significant environmental impact.

Roger Tuttle explained that now that there is public sewer and water hook-up available, it is a good time to make it a year-round residence.

1035-21A: by Donna Cathy, Trustee of Waterloo, NY for the property at 6947 Clapper Rd. to revise lot line to subdivide an existing parcel into 3 parcels. 4.2.2.1 Schedule of minimum area and yards in the A5A district to be 50 ft. setback from all property lines. Parcel A&B do not meet the minimum requirements for a width of 400 ft.. Side setback for existing garage/apartment on parcel B of 19 ft.. Leach system on parcel A to be less than 10 ft. from property as defined in the Town of Huron Septic Law. 

Gordon Smith moved, seconded by Tom Hamilton, that the Board find this request for Area Variance to be an Unlisted Action of section 617.5, having no significant environmental impact.

Don Lewis,  Engineer Representative for the Donna Cathy, Trustee, elaborated on the plans for the property if the variance is granted.

 

Bob Lannon asked if there was anybody here to speak on behalf of the applicant or in opposition of the application.

 

Eli Bliss  representing Kathleen Cathy who resides at 6981 Clapper Rd., was unclear of what was taking place at 6947 Clapper Rd.  Once understood after explanation by Don Lewis, he had no objection to the plans.

All members inspected and/or are familiar with the site. Upon completion of Finding of Facts David Fantuzzo moved, seconded by Tom Hamilton to approve the application as submitted.

Other business:

The request from Keith Smith to rehear the case 1031-20A was presented to the Zoning Board of Appeals. On motion to rehear the case:

Vacant Zoning Board Seat:

The Zoning Board conducted an interview with applicant Shelly Cahoon, including a Q & A regarding the Board's function.

 

Following the interview the Board decided to recommend her appointment to the Zoning Board of Appeals by the Town Board. All in Favor.

 

Meeting Schedule:

2021 meeting schedule was approved by the Town Board

 

Election of Officers – Chairman: Bob Lannon was nominated by David Fantuzzo and elected on a motion by Amy Connelly. Vice Chairman: David Fantuzzo was nominated by Amy Connelly and elected on a motion by Bob Lannon. All in favor.

 

The Board spoke of the training needed for 2021.
