Meeting called to order at 7:00 p.m. by Chairman Bob Lannon.

Chairman Bob Lannon welcomed everyone.
   
Roll Call      
Upon roll call the following members were present: Chairman Bob Lannon, Tom Hamilton, Amy Connelly, David Fantuzzo, Gordon Smith, Shelly Cahoon and Jeff Simonet absent.
      
Others Present:  Building Inspector Roger Gallant, Clerk Diane Bean.

Minutes:
A motion was made by David Fantuzzo, seconded by Tom Hamilton to approve the minutes of the January 12, 2021 meeting. 6 in favor, and Jeff Simonet absent.

New Application:

1039-21A: by Carol LaValley of North Rose, NY for the property at 72117-12-950580 Bayshore Rd. to rebuild and expand existing garage. The Town of Huron Zoning Law Section 4.6.1.12 Alterations, Expansion, Relocation and Extensions to a Building, Structure or Lot Not Conforming to Dimensional Requirements. Any structure or building alteration, expansion, relocation, construction, reconstruction, or extension of use, to an existing structure, building or lot not conforming to dimensional requirements of this law in the Resort district shall not be allowed unless granted a Variance by the Zoning Board of Appeals.

Amy Connelly moved, seconded by Gordon Smith, that the Board find this request for Area Variance to be a Type II action of section 617.5 (c) (12) of SEQRA, having no significant environmental impact.

Carol Lavalley explained that the existing garage is falling down.  Replacing it with a larger garage she will have room for truck, tractor and lawn mower.

Bob Lannon asked if there was anybody here to speak on behalf of the applicant or in opposition of the application. There wasn’t anyone present.

Correspondence: Bob Lannon read an approval letter from Andrew Liszkay of 6217 Bayshore Rd.

Bob Lannon informed the Board that this is a pre-existing unique situation and doesn’t allow for any other options.
David Fantuzzo read the LWRP recommendation letter.

Bob Lannon closed the public hearing: All in favor.

All members inspected and/or are familiar with the site. Upon completion of Finding of Facts Tom Hamilton moved, seconded by David Fantuzzo to approve the application as submitted.

1036-21SP by Chris Howk of Pittsford, NY for the property at 9403 Tosch Rd. to remove existing 8’ x 8’ shed and replace with a 10’ x 18’ storage structure. The Town of Huron Zoning Law Section 4.2 Schedule of Regulations and 4.2.2.1 Schedule of minimum areas and yards requires storage structures in the Resort district shall not to be allowed unless a Special Permit is granted by the Zoning Board of Appeals.

Gordon Smith moved, seconded by Amy Connelly, that the Board find this request for a Special Permit to be a Type II action of section 617.5 (c) (12) of SEQRA requiring a short Environmental Assessment Form (EAF).

Gordon Smith conducted completion and moved acceptance of Part II of the SEQRA Short Environmental Assessment Form (EAF): seconded by Amy Connelly. All in favor.

Chris Howk advised the Board of his plan to remove the existing shed and replace it with a larger one to facilitate storage of water activity accessories: His shed would be adjacent to the shed on his neighbor's property.  In discussion with his neighbor Mike Severn, he learned Mike plans to remove his shed.  Chris is trying to come up with an alternative location to improve the view for all, but would like to keep the structure on the east side of his property.

Bob Lannon mentioned that the Board is generally opposed to shed structures being built on the waterfront.

Tom Hamilton asked if he was opposed to placing the storage structure across the road. Chris said in the future he would like to build a garage across the road.

Bob Lannon asked if there was anybody here to speak on behalf of the applicant or in opposition of the application.

Mike Severn of 9407 Tosch Rd. advised the Board that his concern is the shed will obstruct his view of the water - "… if you look down Tosch Road you will see that there aren’t any sheds on the shoreline."  He had other suggestions as to where the shed could be placed without blocking the view.

David Fantuzzo read the LWRP recommendation letter.

Chairman Lannon presented Chris Howk with two options: (1) Request the Board to make a decision now, or (2) table the application and come back to the Board with more definitive information.  He chose to have his application tabled.

Chairman Lannon made the motion to table this until the April meeting.  All in favor.

The public hearing remains open. All in favor.

1038-21A: by Jan Brewster of Scottsville, NY for the property at 10328 Carolina Ave. to add square footage to the second floor. The Town of Huron Zoning Law Section 4.6.1.12 Alteration or addition to pre-existing non-conforming structure in the Resort district shall not be allowed unless granted a Variance by the Zoning Board of Appeals.

Amy Connelly moved, seconded by Gordon Smith, that the Board find this request for Area Variance to be a Type II action of section 617.5 (c) (11) of SEQRA, having no significant environmental impact.

Jan Brewster explained that he wanted to add a 60ft shed dormer to his cape style home.

Kip Finley the engineer for the Brewster project explained what he is proposing to do.

Bob Lannon asked if there was anybody here to speak on behalf of the applicant or in opposition of the application. There wasn’t anyone present to oppose the application.

David Fantuzzo read the LWRP recommendation letter.

Bob Lannon closed the public hearing: All in favor.
