REGULAR MEETING February 22, 2011

 

Call to Order

Regular Meeting of the Huron Town Board was called to order by Supervisor Laurie Crane at the Huron Town Hall on February 22, 2011, at 7:00 p.m.

 

Flag Salute

Supervisor Crane led the flag salute.

 

Roll Call

Upon roll call the following members were present: Supervisor Laurie Crane, Councilmembers Alan Traister, Russell Teeple, Lois Buckalew and Councilmember David Buisch.

Supervisor Crane welcomed everyone.

Public Participation

Supervisor Crane asked if there was anyone from the public that wished to speak.

 

Correspondence

The following correspondence was received and filed:
1. Received the Certificate of Liability Insurance for Wayne Co. and Time Warner.
2. Received the Personal Training Record for Lawrence Lockwood.


Discussion of Correspondence

There was no discussion on the correspondence.


Property Reval Comments

Dennis Grandjean spoke that he has been provided with the information from Assessor Scudder and said the data does not show what he expected the data would show. His overall neighborhood is concerned. He serves on the Shaker Heights Board and they feel that Dennis should be knowledgeable of what is going on. He thanked the board for working with them.  Assessor Scudder spoke that the national market is up for 2010. He was in Batavia today and they continue to work on the reval. Notifications of new assessment will be going out at the end of March. The state is cutting back in a number of places. This will be the last year for State Training. Cyclical Aid will have huge cuts; which is the $5.00 per parcel or not. Depending on whether or not the state funds it.

 

Blue-Green Algae Review

Town Board members:

   Unable to attend Tuesday's meeting, I request that this letter be read at the meeting and included in the minutes.

   I would suggest that since waterfront property owners provide approximately 80% of Huron's property tax revenue, it is in the Town's best interest to safeguard the health of Sodus Bay, its prime income source.

   I have four straightforward questions for the Board:

  1.  Does the Town consider it their responsibility to deal with Sodus Bay's weed & blue/green algae issues?

  2.  Has the Town filed applications for permits regarding the chemical control of weeds & blue/green algae?

  3. What funds have been allocated to lessen the likelihood of the return of the algae and the chemical treatment of weeds?

  4.  What is the Town's strategy for dealing with these issues?

The board answered the above questions:

1. Yes. We have been dealing with these issues right along. $9000.00 is taken out of the general fund for Weed Harvesting in the bays. We have been proactive with the septic issues as well, and have a septic law in place. Supervisor Crane has participated in numerous meetings dealing with the blue-green algae problem.
2. Yes, in the past. Recently, no because the DEC has until now denied chemical application except in East Bay. That is why Wayne County Soil and Water and the Town has focused on harvesting the weeds.
3. Current funding is allocated to harvesting.
4. To pursue all avenues open to it, to preserve and protect the health of our bays.

Councilmember Buckalew questioned the 80%; Assessor Scudder responded that all neighborhoods but one is waterfront. The last time the numbers were run he had come up with 49.1% with about half coming from waterfront. Councilmember Buisch suggested samples should be taken and testing done to determine the level of toxins remaining in the water. David Scudder said there is a Businessman's organization being formed for ongoing communication; there are also people looking into testing. The Board agreed that samples should be taken as soon as possible and tested. Kathy Grandjean inquired how anyone will know whether or not the water is safe. Supervisor Crane will ask Wayne County Soil and Water to take samples for testing. Several means of disseminating the information once testing results are known were discussed-Dennis Grandjean suggested that SOS would also be a good way to get word out.

 

Village of Wolcott Wastewater Treatment Facility

Councilmember Teeple moved, seconded by Councilmember Buckalew to recommend WCWSA be lead agency for this project. All in favor.

 

Weed Harvesting Update for Ann Lee Drive

Dennis Grandjean spoke that he is very concerned about Ann Lee Drive and the weeds. The weeds were horrible on Ann Lee Drive last year. There was discussion on an access point at Spiegel Drive and there will be a meeting with Supervisor Crane, the committee on Spiegel Drive and Soil and Water as soon as committee members return from Florida. Dennis Grandjean would also like to set up a meeting with his committee, Supervisor Crane and Soil and Water. There was also discussion on using a barge.

 

CDBG

Councilmember Buisch will look over the letter that was sent last year and will be put on the agenda for March 21, 2011 Regular Town Board Meeting.

 

Town Clean-Up

The Spring Clean-up has been scheduled for Saturday June 4, 2011. We have received one bid so far.

 

RESOLUTION #117-2008

Discussion was had on this resolution and was decided that it is correct as written.

 

Digital Recorder

Town Clerk spoke that our recorder has stopped working and we are researching going with a digital recorder.

 

Electrical Issues

Supervisor Crane spoke on an electrical issue that occurred on January 28, 2011 at the Town Hall. There was a short at the Pole which caused a power surge in the town hall, there was an explosion in the justice office that burned up a battery back-up, surge protector and power supply out of the justice computer, it fried the automatic transfer switch to the generator and you could not manually override it. Two battery back-ups had to be replaced; it also caused issues with the server. Jose at BAS was able to get ahold of Dell and the justice computer was still under warranty and was repaired. NYMIR will contact RG&E for repayment of the bills that were incurred. There was no bill from BAS submitted for they felt that the time that was put in was a learning experience for them. What they learned from this will better serve us in the future. There was also discussion on switching to single phase service. Supervisor Crane will contact someone from RG&E to come out and assess our situation.


Returned Check Fee

Councilmember Buckalew moved, seconded by Councilmember Teeple to increase the returned check fee to $25.00. All in favor.

 

RESOLUTION #17-2011
Permission for Town Clerk to Attend NYSTCA Conference

On motion of Councilmember Buckalew, seconded by Councilmember Buisch the following resolution was ADOPTED - AYES 5 NAYS 0.
 RESOLVED, to allow Town Clerk to attend the NYSTCA Conference in Buffalo May 1-4, 2011.

 

Committee Reports

Councilmember Teeple
Water Districts: Water District 6&7 are moving forward.

Councilmember Traister
Justice Monthly Report: Councilmember Traister moves, seconded by Councilmember Buisch to approve the December and January monthly Justice court report. All in favor of this motion.
Historian Report: Historian Flint asked for permission to attend the annual 2011 APPHNYS Conference. She also gave her Historian Report and an Annual Report that was received and filed.


Councilmember Buckalew
Assessment:  Assessor Scudder reported that there will be a Public Informational Meeting on the reval on Thursday February 24, 2011 at 7:00 p.m at the Huron Town Hall.
Buildings: Councilmember Buckalew, Teeple and Building Inspector Gallant will meet on Thursday February 24, 2011 at 10:00 a.m. to open the quotes for the building addition.
Paychex Handbook: There have been two meetings, Councilmember Buisch has called Paychex and has gotten no response.
Time Warner:  Councilmember Buckalew attended a meeting for the Time Warner negotiations.

Planning Board: Councilmember Teeple moved, seconded by Councilmember Traister to receive and file the Planning Board minutes of January 10, 2011.  Motion carried.
Zoning Board: Councilmember Teeple moved, seconded by Councilmember Teeple to receive and file the Zoning Board minutes of January 18, 2011. Motion carried.

 

RESOLUTION #18-2011
ZBA Appointment

On motion of Councilmember Buisch, seconded by Councilmember Teeple the following resolution was ADOPTED - AYES 5 NAYS 0.
 RESOLVED, to appoint Kathy Wachtman to the ZBA for a term to expire December 31, 2015.
Committee Reports Cont.
Receive & File Building Inspector's Monthly Fee Reports: Councilmember Buisch moved, seconded by Councilmember Teeple to receive and file the Building Inspector's January monthly fee report.  Motion carried.


Building Inspector Report: Building Inspector Gallant reported that hopefully business will be picking up. BAS has been working on their concerns. He has also met with WCWSA for Water #7 for the Building Inspector's help to point out any issues or septic systems that might be in the way of the Waterline. There was snow buildup on the roof that he took care of but it caused water damage in the Building Inspector's office.

Record's Management Grant

Donna Traister thanked Town Clerk Vezzose and Kathy Wachtman for all the hard work that they put in to apply for the record's management grant. The Town Clerk then thanked Donna for all the hard work she also put into the grant as well. There was a lot of work and time put into this grant, we applied for a Records Conversion and Access Grant to have our birth, death and marriage, local laws, town board minutes, payroll etc. be microfilmed and indexed. We also asked for new filing cabinets for the building inspector's office. There will be a lot of work to be done if the grant is approved. Supervisor Crane thanked the girls for all their hard work.

Town Clerk's Monthly Report: Councilmember Buisch moved, seconded by Councilmember Traister to approve the January 2011 monthly report of the Town Clerk.  Motion carried.
Town Board Meeting Minutes: Councilmember Traister moved, seconded by Councilmember Buckalew to approve the January 18, 2011 regular meeting minutes. Councilmember Teeple abstained. Motion carried.
Town Clerk's Annual Report: Councilmember Buisch moved, seconded by Councilmember Traister to approve the 2010 Annual Town Clerk Report. Motion carried.
Supervisor's Report: Councilmember Buisch moved, seconded by Councilmember Traister to receive and file the Supervisor's report for January.  Motion carried.

Supervisor reported on the following: 
 Supervisor Crane took a tour of the new Public Safety Building.
 Lyons National Bank came out and gave a demonstration of the LNB Check Reader. It was very impressive. We will check with BAS and make sure there will be no issues. We will need to purchase a laptop to be shared with Town Clerk, Supervisor/Account Clerk, and Court Clerk as well as to be used for Town Board Minutes.
 Time Warner Hook-Up will possibly start in the spring.
 Supervisor Crane attended a Luncheon with Assemblyman Oaks.
 Received a Letter from Town of Sodus-Lead Agency for Zoning Code Changes.
 AUD has been done; accountant will be out on Thursday to finish up.

 Permission for Supervisor to Attend Conferences

 On motion of Councilmember Buckalew, seconded by Councilmember Teeple the following resolution was ADOPTED - AYES 5 NAYS 0.
  RESOLVED, to allow Supervisor Crane to attend Basic Accounting Class in the Town of Marcy and the Minnow brook Conference.

Attorney Kanyuck
LWRP Committee: Attorney Kanyuck asked how we were coming on forming the committee. We will continue to work on this.
