Regular Meeting, 15 July 2011 

 

Call to Order

Regular Meeting of the Huron Town Board was called to order by Supervisor Laurie Crane at the Huron Town Hall on July 18, 2011, at 7:00 p.m.

 

Flag Salute

Supervisor Crane led the flag salute.

 

Roll Call

Upon roll call the following members were present: Supervisor Laurie Crane, Councilmember Alan Traister, Russell Teeple, Lois Buckalew and David Buisch.

 

Welcome

Supervisor Crane welcomed everyone.

 

Correspondence

The following correspondence was received and filed:

1. A letter from the Department of State that Local Law #2 of 2011 has been received and filed.
2. Received the Certificate of Liability Insurance for Syracuse Constructors.
3. Thank you from NRW Project Graduation Committee for our support.
4. Received a letter from Marty Aman of WCWSA to Michael Vogt President of B.Beardsley Management in regards to Water District #5 being incomplete.

 

Discussion of Correspondence

There was no discussion on the correspondence.

 

Project Graduation Report

Eric VanFleet spoke on attending Project Graduation; he thanked the Town for contributing to Project Graduation.  They had a great time. There were Door Prizes, Food and Activities.  About 92 students attended 68 graduating seniors and 24 guests who have to pay a fee to attend. Deb Phillips also thanked the town for their support and hoped for our continued support. Deputy Highway Superintendent thanked Deb Phillips for all that she does for the organization.

 

Quote for Propane

Councilmember Traister will work on the Propane and will present something at the next meeting.

 

RESOLUTION #66-2011
Returned Check Fee

On motion of Councilmember Teeple, seconded by Councilmember Traister the following resolution was ADOPTED - AYES 5 NAYS 0.

 WHEREAS, on February 22, 2011 the Town Board voted to increase the fee charged by the Town for checks that are returned or dishonored from twenty dollars to twenty-five dollars; and

 WHEREAS, since that time one payment made by check to the Town have been returned or dishonored; and

 WHEREAS, the fee charged by the Town for returned or dishonored checks should not exceed twenty dollars;

 NOW, THEREFORE, BE IT RESOLVED that the Town of Huron shall charge twenty dollars for checks returned or dishonored; and

 BE IT FURTHER RESOLVED that the Town Clerk is directed to issue a five dollar refund to those charged twenty-five dollars since February 22, 2011.

 

Health Insurance

Councilmember Buckalew moves, seconded by Councilmember Buisch to table this to August 15, 2011.

 

Assessment Department

Attorney Knauf addressed a case which may proceed to court.
The procedure to change to a Single Appointed Sole Assessor was discussed further. Councilmember Teeple moved, seconded by Councilmember Traister to hold a public hearing on August 15, 2011 at 7:30 p.m. All in favor of this motion.

 

Committee Reports

Councilmember Teeple
Water District #5: WCWSA will be finishing up the work that needs to be done.
Highway: Councilmember Teeple commented on the great job that Deputy Highway Superintendent Reyn has been doing.
Water District #6&#7: Public Informational Meeting will be held at the Huron Town Hall at 6:30 p.m.


Councilmember Traister
Historian Report: Carol Flint spoke that the trees at the schoolhouse need to be looked at; Deputy Highway Superintendent Reyn will have this checked out.
Justice Court Report: Councilmember Traister moved, seconded by Councilmember Teeple to receive and file the June Justice Court Report.


Councilmember Buckalew
Assessment:  Assessor Scudder reported that it is a slow period; have only received 3 small claims; Concerning weed harvesting, Assessor Scudder indicated harvesting should be back on schedule by noon tomorrow- they have been waiting for a drum of vegetable oil.
Buildings: Building Inspector Gallant has met with Jeff from RG&E and he will be doing a physical inspection of our site, it will be looked at from all angles. With regards to Town Hall repairs project, Roger would like to get the committee together.

RESOLUTION #67-2011
Phone for Deputy Highway Superintendent
On motion of Councilmember Buisch, seconded by Councilmember Teeple the following resolution was ADOPTED - AYES 5 NAYS 0.
RESOLVED to go into contract with Verizon for a government contract for a durable phone with GPS and internet for $149.99 and a cost of $50.00 per month with 400 shared minutes and it will be taken out of account 50104a.

Councilmember Buisch
Receive & File Building Inspector's Monthly Fee Report: Councilmember Buisch moved, seconded by Councilmember Teeple to receive and file the Building Inspector's June monthly fee report.  Motion carried.
Planning Board Minutes: Councilmember Buisch moved, seconded by Councilmember Traister to approve the June 6, 2011 Planning Board meeting minutes.  Motion carried.
Zoning Board Minutes: Councilmember Buisch moved, seconded by Councilmember Teeple to approve the June 14, 2011 Zoning Board meeting minutes.  Motion carried.
Building Inspector Report:
 There may be a claim for a home owner's bathroom vanity fixtures which was stained by the dye from a septic inspection.
 Issue on Port Bay Water District; there is someone with no insurance and they also may be undercutting to be able to insure that they get the projects. Councilmember Buisch will post a message on the website.
 RG&E is trimming trees on the Sandbar.
 Crescent Beach Septic will need a blanket variance from the Zoning Board.
 Building Inspector Gallant and Assessor Scudder will work together on issues that need to be addressed on Area Coverage and in reference to decks

RESOLUTION #68-2011
Permission to Advertise for Additional Septic Inspectors

On motion of Councilmember Teeple, seconded by Councilmember Buckalew the following resolution was ADOPTED - AYES 5 NAYS 0.
  RESOLVED, to authorize Building Inspector Gallant to contract inspectors as needed and to advertise, if necessary.

 

RESOLUTION #69-2011
Permission to set Elevation Benchmarks in the Town

On motion of Councilmember Buckalew, seconded by Councilmember Buisch the following resolution was ADOPTED - AYES 5 NAYS 0.
 RESOLVED, to accept the proposal from Shelley Associates to set elevation bench marks in 5 different sites in the town at a cost of $3500 to come from contingency and to be taken out of account 3620401a.

Town Clerk's Monthly Report: Councilmember Buisch moved, seconded by Councilmember Teeple to approve the June monthly report of the Town Clerk.  Motion carried.
Town Board Meeting Minutes: Councilmember Buisch moved, seconded by Councilmember Traister to approve the Special Meeting Minutes of June 2, and 6, 2011, Workshop Minutes of June 27, 2011 and the June 20, 2011 regular minutes. Motion carried.
Supervisor's Monthly Report: Councilmember Buisch moved, seconded by Councilmember Buckalew to receive and file the June monthly Supervisor's report.  Motion carried.

RESOLUTION #70-2011
Adopt Handbook

On motion of Councilmember Teeple, seconded by Councilmember Buckalew the following resolution was ADOPTED - AYES 5 NAYS 0.
 RESOLVED, to adopt the Employee Handbook.

 

Committee Reports - Continued:

CDBG Loan: Discussion of a lien on the property of a deceased resident, for the CDBG loan and whether the loan could be repaid by whoever purchases the property.
SBIA Luncheon: Supervisor Crane spoke at the SBIA Picnic, as well as Marty Aman and Dr. Boyer. Supervisor Crane thanked Donna Traister for attending and notarizing 5 easements.
Blue-Green Algae: All indicators suggest that blue-green algae will more than likely be back this year. Testing for toxins from last year's bloom in Sodus Bay have been conducted every two weeks, with negative results. Anyone seeing evidence of blue-green algae is requested to email Dr. Boyer at: glboyer@esf.edu.
Property Clean-Up: The recouped $2974.00 cost for property clean-up in 2010, is a refund to prior years expenditures.
Article 10 of the Power of NY Act of 2011: Alan Isselhard brought in a packet on this law that was revised and adopted June 22, 2011; part of the State's move to override local authority with regard to the selection of sites for energy projects.

LWRP: Councilmember Traister moves, seconded by Councilmember Teeple to accept the following individuals to the LWRP committee: Scott Marshall, David Hoey, Shelley and David Usiatyski and Jeff Simonet.

RESOLUTION #71-2011
Permission for Supervisor Crane to sign letter to DEC

Councilmember Buisch moved, seconded by Councilmember Traister the following resolution was ADOPTED - AYES 5 NAYS 0.
 RESOLVED, to grant Supervisor Crane permission to sign letter to Jeff Myers of DEC concerning the key TMDL's (Total Maximum Daily Load) for Sodus Bay.

 

RESOLUTION #72-2011
Borschoff Settlement

On motion of Councilmember Buckalew, seconded by Councilmember Buisch the following resolution was ADOPTED - AYES 5 NAYS 0.
 RESOLVED, to approve the out of court settlement in the matter of Borschoff V. Town of Huron et.al. accepting a vacant parcel full assessed value in the amount of $149,600 and an improved adjacent parcel property with full assessed value of $250,000 and withdrawal of the  ongoing lawsuit by the plaintiff.

On motion of Councilmember Buisch, seconded by Councilmember Buckalew the following resolution was ADOPTED - VOTE - AYES 5 NAYS O.
     RESOLVED, to approve the following transfers:
