Regular Meeting - 19 September 2011
Call to Order
Regular Meeting of the Huron Town Board was called to order by Supervisor Laurie Crane at the Huron Town Hall on September 19, 2011, at 7:00 p.m.

Supervisor Crane led the flag salute.
Roll Call
Upon roll call the following members were present: Supervisor Laurie Crane, Councilmember David Buisch, Russell Teeple, Lois Buckalew and Alan Traister.
Welcome
Supervisor Crane welcomed everyone.
Correspondence
The following correspondence was received and filed:
1. A renewal Application from R Bar and Grill to Town Clerk that they are renewing their Liquor License.
2. A letter from Knauf Shaw to Kate Peters Court Assistant for Wayne County Court in regards to Town of Huron SCAR Proceedings.
3. A letter to Supervisor Crane from Unified Court System in regards to an audit is conducted on Justice Finances and records and to forward the copy of the report and the resolution.
4. Received a copy of Progress Meeting No. 2 Meeting Minutes and Attendance Sheet.
5. Received information on Obesity from NYS Department of Health.
6. A copy of a letter to Hyland Hartsough of NYS Dept of Health from Martin Mroczek of MRB in reference to Water District #7 Certification of Partial Completed Works.
7. Received a copy of a letter from Sheryl Robbins of NYS Dept. of Health to Laurie Crane and the Huron Town Board in regards to Water District #5 Public Water Supply for Empire Fruit Growers.
8. Received a Letter from Iberdrola USA in regards to the claim we submitted to RG&E on 01/28/2011.
9. A letter to Supervisor Crane from MRB Group in regards to WD#5 Booster Pump Station.
10. Received a copy of a letter from Sheryl Robbins of NYS Dept. of Health to Laurie Crane and the Huron Town Board in regards to Water District #7 Public Water Supply for Partial Approval for West Port Bay Road
11. A letter from William Reemsten of Stu Brown Associates to Cynthia Newcomb of USDA- Rural Development in regards to Pre Bid/Pre Construction Documentation.
12. A letter from NYS Department of State to the Town Clerk that Local Law #3 of 2011 has been filed.
13. An email from Barbara Johnston Consultant for LWRP for Summary of Accomplishments through July 29, 2011.
14. A letter to Supervisor Crane from Rose Free Library for 2012 Funding Request.
Discussion of Correspondence
#8 Supervisor Crane wondered if there were any legal grounds upon which to appeal RG&E's decision rejecting the Town's reimbursement claim for damages. Attorney Knauf will review the matter.
George Lockwood
George Lockwood addressed the Board on behalf of WAVAC, explaining their request for financial support from the municipalities served by WAVAC. They have not solicited funds in the past, relying on voluntary contributions and the income from services provided. However, with the economic downturn over the past several years, they have experienced a steady decrease in revenue due mainly to greater frequency of incidents where help is needed by individuals unable to pay for the service. For lack of volunteers, paid staff positions were introduced, adding to the overhead costs. Over the same period of time, other costs (fuel, equipment, insurance) have steadily increased: Voluntary contributions have not kept pace, resulting in a growing deficit. Supervisor Crane expressed no surprise. Town of Huron residents have benefited from the emergency medical ambulance service since 1972. It is a vital service to the community. The proximity to hospital services results in 3 hours for an average service call. WAVAC faces the very real possibility of closure, without financial support. They are requesting $10,000 from each municipality, to cover the cost of insurance and fuel.

Public Hearing for WAVAC
On motion of Councilmember Buisch, seconded by Councilmember Teeple to hold a public hearing on October 17, 2011 at 7:45 p.m.
7015 Owen Shore Road
Mrs. Croyle addressed the Board, expressing concern over the excessive use of the road on which she resides; much of it by other than residents. Her letter to the Board detailed the issues: Garage sales 4 times a year, blocking driveways; county weed harvesting equipment blocking the road; constant traffic to a boat-launch facility - all of which she reiterated. Supervisor Crane pointed out that the road is a private road over which the Town has no jurisdiction. The road and the boat launch are owned by Teeple Farms. In response to Mrs. Croyles grievance, a representative of Teeple Farms gave permission to place a "Private Road" sign at the entrance to discourage unauthorized use. The Wayne County Soil and Water District will be approached to avoid blocking the road with their equipment in the future.
RESOLUTION #87-2011
Public Hearing for Huron-Wolcott Fire Protection
On motion of Councilmember Buisch, seconded by Councilmember Traister the following resolution was ADOPTED - AYES 5 NAYS 0.
RESOLVED, to hold a public hearing on October 17, 2011 at 7:30 p.m.
NYS Retirement
Councilmember Buckalew moved, seconded by Councilmember Buisch to pay retirement at the November 21, 2011 Regular Town Board Meeting.
RESOLUTION #88-2011
Move Expansion
On motion of Councilmember Buckalew, seconded by Councilmember Buisch the following resolution was ADOPTED - AYES 5 NAYS 0.
RESOLVED, to amend resolution #83-2011 from building repairs to 1620408A (office expansion) $25,000.
Fire Extinguishers
Building Inspector Gallant expressed dissatisfaction with the service the Town has been receiving from the current contractor. Fire prevention regulations require that fire extinguishers be regularly checked, maintained and replaced as necessary. He is investigating other service providers. This issue has been tabled to the next meeting.
RESOLUTION #89-2011
Advertise for Appointed Sole Assessor
On motion of Councilmember Buisch, seconded by Councilmember Traister the following resolution was ADOPTED - AYES 5 NAYS 0.
RESOLVED, to advertise for an appointed sole assessor in the Fingerlakes Times, Times of Wayne County and on the Association of Towns, NY Assessor.Com and the Town of Huron website at a cost to not exceed $1000.00 and the funds will come from 1355400A.
Septic Complaint
The attached letter was received from a resident in regards to the septic law:
Hi Roger,
I have no problem complying with the laws in the town of Huron but I do feel that we lack consistency among other towns that border Sodus Bay. Why do they not have similar laws such as ours when it comes to septic systems? We all need to do our part in keeping Sodus Bay clean but it appears that these other towns are getting a free pass when it comes to septic system laws. I would appreciate it if the town could pursue this issue further.

Request for Water
Town Clerk Vezzose received a request from a resident on Powers Road be added to Lasher Road, Wilson Road and North Huron Road. Supervisor Crane will contact Dave Doyle.
Committee Reports
Councilmember Teeple:
Deputy Highway Superintendent Reyn: Working on sand stock; the price of sand has gone up.
Water District #6: Supervisor Crane received a NYS Labor form for endorsement, from Syracuse Constructors. They are requesting a dispensation of hours in connection with future work on Water District #6; she will contact Dave Doyle concerning the matter and bring it up at the budget meeting on September 21, 2011.
Councilmember Traister
Historian: Carol Flint thanked highway for patching holes in the historical buildings and Councilmember Buisch for the 9/11 observance and placing the link for the 9/11 Memorial Flag on the town website. She also inquired if the County could adopt 911 Memorial Flag. Supervisor Crane will bring the matter up at the next County Meeting.
Animal Control Inspection Report: Councilmember Traister reported that everything is good.
Justice Court Report: Councilmember Traister moved, seconded by Councilmember Buisch to receive and file the July and August Justice Court reports.
Councilmember Buckalew
Assessment: Assessor Dave Scudder reported that they have 3 more hearings scheduled and have no responses on any cases that have already been heard. He felt that they have had very good hearing officers.
Buildings: Building Inspector Gallant reported that the roof repair work will commence as soon as the Contractor is available.
Councilmember Buisch
Receive & File Building Inspector's Monthly Fee Report: Councilmember Buisch moved, seconded by Councilmember Teeple to receive and file the Building Inspector's August monthly fee report. Motion carried.
Building Inspector Report:

•· There are 32 septic inspections to be completed this year.
•· Empire Fruit Growers packing plant is up and running.

Permission for Building Inspector Gallant to Purchase Computer
On motion of Councilmember Buisch, seconded by Councilmember Teeple the following resolution was ADOPTED - AYES 5 NAYS 0.
RESOLVED, to authorize the purchase of a new computer for Building Inspector Gallant at a cost to not exceed $1000.00.

Memory of Fritz Wafler
Supervisor Crane read a resolution in memory of Fritz Wafler whom served the Town from 1973-1976 and 1976-1990, this resolution will be included in the September 19, 2011 regular meeting minutes and a copy will be presented to the family of Fritz Wafler.
Memory of Ezra Bishop
Supervisor Crane read a resolution in memory of Ezra Bishop whom served the Town from 1948-1977, this resolution will be included in the September 19, 2011 regular meeting minutes and a copy will be presented to the family of Ezra Bishop.
Memory of Michael Kier Sr.
Supervisor Crane read a resolution in memory of Michael Kier Sr. whom served the Town from 2002-2003, this resolution will be included in the September 19, 2011 regular meeting minutes and a copy will be presented to the family of Michael Kier Sr.
Memory of James Sharpe
Supervisor Crane read a resolution in memory of James Sharpe whom served the Town from 1964-1975, 1976-1983 and 1984-1992, this resolution will be included in the September 19, 2011 regular meeting minutes and a copy will be presented to the family of James Sharpe.
Memory of Al Guerin
Supervisor Crane read a resolution in memory of Al Guerin whom served the Town from 1996-1999, this resolution will be included in the September 19, 2011 regular meeting minutes and a copy will be presented to the family of Al Guerin.

Town Clerk's Monthly Report: Councilmember Buisch moved, seconded by Councilmember Buckalew to approve the July monthly report of the Town Clerk. Motion carried.
Town Board Meeting Minutes: Councilmember Buisch moved, seconded by Councilmember Traister to approve the August 15, 2011 regular Meeting minutes.
Supervisor's Monthly Report: Councilmember Buisch moved, seconded by Councilmember Buckalew to receive and file the August monthly Supervisor's report. Motion carried.
County Issues:
•· Supervisor Crane gave Town Clerk Vezzose Lifeline brochures to be placed in the foyer.
•· Received an email in regards to COAX (Home Rule); Councilmember Buisch will present at the next meeting
•· Received a letter from Roger Humbert in regards to a refund for taxes paid in 2008-2010.
•· Letter from DEC in regards to the public hearing on conserving water on 7-22-11.
•· Notification from NYMIR on Workplace Violence and sexual harassment seminar being held on Wednesday September 28, 2011. Councilmember Buisch will attend and report back.
•· Received a letter from Wayne County Office of Administrator in regards to workers compensation self insurance plan.

On motion of Councilmember Buckalew, seconded by Councilmember Buisch the following resolution was ADOPTED - VOTE - AYES 5 NAYS 0.
