REGULAR MEETING March 19, 2012 

    

Call to Order

Regular Meeting of the Huron Town Board was called to order by Supervisor Laurie Crane at the Huron Town Hall on March 19, 2012, at 7:00 p.m.

  

Flag Salute

Supervisor Crane led the flag salute.

  

Roll Call

Upon roll call the following members were present: Supervisor Laurie Crane, Councilmembers David Buisch, Russell Teeple, and Lois Buckalew. Councilmember Alan Traister was absent.

  

Welcome

Supervisor Crane welcomed everyone.

   

Announcements

There were no announcements.

  

Public Participation

Supervisor Crane asked if there was anyone from the public that wished to speak.

  

Correspondence

The following correspondence was received and filed:

1.     Received a notice of issuance of Magazine Certificate for Howard Pettit of Pettit's Gun Shop.

2.     A letter from North Rose-Wolcott High School asking for our support for the 2012 Project Graduation.

  

Discussion of Correspondence

#2 Russell Teeple asked if this is a budgeted item; which it is.

         

Charles Schaufelberger

Charles Schaufelberger residing at 7392 Phelps Avenue addressed the Board regarding his house.  The house located on Leroy Island was destroyed by fire February 16, 2012.   He expressed concern for the fact that the new water service fire hydrants were still covered and no one knew whether or not they were live and could be used.  As a result, valuable time to fight the fire was lost.  His purpose in coming to the Board was to ensure that better communication be established between the water authority and the fire departments as to when the hydrants can be used, to avoid a recurrence of this situation. Laurie Crane explained that this was unfortunately a situation where the contractor had not yet turned the project over to the water authority; that under normal circumstances the fire departments are informed of all hydrant conditions by the water authority.  Mr. Schaufelberger commended the North Rose Fire Department on their overall performance.

         

Mr. Schaufelberger also requested the property assessment be revised on the tax roll.  He had discussed the matter with Assessor Roach, presenting a letter confirming his request.    He asked Assessor Roach to sign his letter confirming his request but was refused.  Assessor Roach confirmed the incident to the Board that he had duly noted Mr. Schaufelberger's request but as a matter of policy, does not sign documents he has not been a party in creating.    Assessor Roach responded to Mr. Schaufelberger's request for an explanation of the tax roll process.  Mr. Schaufelberger thanked the Board for their time.

        

Benefit Unit Policy

Councilmember Buckalew moved, seconded by Councilmember Teeple to move the benefit unit changes as follows:

insert, page (3) of Policy Regarding Benefit Charges for the Financing of Debt Service for Town Water Districts:

     

 C.     Properties divided by district or Town lines.  The benefit unit charge will be assessed by the district/Town in which the residence is located.  The remaining property, if in the Town of Huron, will be assessed 5% of a unit charge if it is of a size suitable for building.

  

 D.     Properties extending between two Town roads.  When properties extend between two Town roads, one road falling within a water district, the residence address will determine if a benefit unit charge is assessed.  In the event the address of the residence is not in the water district, nothing precludes the property owner from requesting hook-up to the water service, for which a benefit unit charge will then be assessed.

  

 E.      Properties with residence situated an unreasonable distance from the water service.  A residence located more than "x" feet from the water service will not be assessed a benefit unit charge unless and until a request for hook-up to the water service is made.

RESOLUTION #35-2012

Benefit Unit Change: Pam Arend

On motion of Councilmember Teeple, seconded by Councilmember Buisch the following resolution was ADOPTED - AYES 4 NAYS 0.

     RESOLVED, to change the water Benefit Unit assessed to Pam Arend's property from 1½ to 1 unit.

     

Sandbags

Building Inspector Gallant received an inquiry from a resident as to where sandbags could be obtained, recommending the Town stock pile them.  According to Supervisor Crane's recollection, they come by the pallet holding 5-10,000 bags. Highway Superintendent Reyn advised that unless they can be properly stored, they rot, as happened to the Town's last stock pile.   The matter will be pursued.

     

RESOLUTION #36-2012

RG&E Bill for Single Phase

On motion of Councilmember Buisch, seconded by Councilmember Teeple the following resolution was ADOPTED - AYES 4 NAYS 0.

            RESOLVED, to approve the voucher for RG&E for $227.50.

     

RESOLUTION #37-2012

LGE 2011-2012 Grant Program

On motion of Councilmember Traister, seconded by Councilmember Buckalew the following resolution was ADOPTED - AYES 4 NAYS 0.

                        LOCAL GOVERNMENT EFFICIENCY (LGE) GRANT PROGRAM

2011-2012 PROGRAM YEAR

  

TOWN OF HURON

RESOLUTION

   

At the meeting of the Town Board of the Town of Huron held on March 19, 2012, the following resolution was moved by Councilperson Buisch, seconded by Councilperson Buckalew and adopted by vote of the Town Board.

RESOLVED:

  

1.     The Town Board of the Town of Huron authorizes the Town Supervisor, Laurie J. Crane, to submit an application to the Local Government Efficiency (LGE) Grant Program for the 2011-2012 Program Year. 

2.     The Wayne County Water and Sewer Authority shall act as the "Lead Applicant" for the LGE grant application, and the Authority's Executive Director, Martin Aman, shall be named as the "Lead Applicant Contact Person" on the grant application form.

3.   The Town Board agrees to serve as "Co-Applicant" and hereby authorizes the Town Supervisor to execute all financial and/or administrative processes and instruments relating to the grant program. 

4.     The application shall request an LGE grant that would enable the Wayne County Water and Sewer Authority to work cooperatively with the Towns of Ontario, Williamson, Sodus, Huron and Wolcott to undertake a study of the long-term water supply needs within the northern corridor of Wayne County and to consider and evaluate regional and/or cooperative solutions to supply and operate public water systems within this area in a cost efficient and effective manner.

5.   The cost of undertaking the study is estimated at $150,000. The Wayne County Water and Sewer Authority, as Lead Applicant, and the Towns of Ontario, Williamson, Sodus, Huron and Wolcott as Co-Applicants will apply for a grant of $135,000.  The required local match for the project is $15,000.  The Wayne County Water and Sewer Authority Board has committed to provide one-half of the required local match, or $7,500, for the conduct of the study.  The Towns of Ontario, Williamson and Sodus have each committed to provide $2,500 to provide the balance of the required local match.

6.   The Town of Huron will work with the Wayne County Water and Sewer Authority as Lead Applicant and the Towns of Williamson, Ontario, Sodus and Wolcott as Co-Applicants to prepare and execute an inter-municipal agreement setting forth individual responsibilities to participate in the conduct of the study and to work toward the implementation of the proposed recommendations.

RESOLUTON #38-2012

Water District #5 Budget Modification

On motion of Councilmember Teeple, seconded by Councilmember Buisch the following resolution was ADOPTED - AYES 4 NAYS

            RESOLVED,

                        Whereas, the Town of Huron developed the budget for the Water District No. 5 project based on estimates for various project costs, and

Whereas, the original project was completed under budget and the Town received approval to utilize the available funding to construct a pump station on North Geneva Road; and

Whereas, it is necessary to install a three-phase electric service to the pump station; and

Whereas, RG&E has estimated the cost for the installation of the three-phase service to be $4,771.67.

Be it resolved that the Town Board hereby authorizes the creation of a budget line under Direct Expenditures in the amount of $4,771.67, with these funds to be drawn from the Contingency.

   

     

Building Inspector Assistant

Building Inspector Gallant interviewed the applicants and is recommending Aron Thompson; a fully certified inspector, familiar with Zoning, Coastal issues, FEMA, Floodplains.  His part time work with another town will not interfere with his availability.  The only conflict that could arise is his active involvement with FEMA in the event of a federal emergency.

     

RESOLUTION #39-2012

Building Inspector Assistant

On motion of Councilmember Buisch, seconded by Councilmember Teeple the following resolution was ADOPTED - AYES 4 NAYS.

            RESOLVED, to appoint Aron Thompson as Building Inspector Assistant effective April 1, 2012.

   

Committee Reports

  

Councilmember Teeple

Water District #6:  Supervisor Crane has received a Certificate of Substantial Completion for her to sign, which she will hold pending more information.

Highway Superintendent Reyn:   Concerning the loader, talked with Teitsworth and they will be coming to look at the loader and see what price it could get at auction. A wing has been ordered for the plow that was damaged.

  

Councilmember Traister (Absent)

Justice Monthly Report:  Councilmember Buisch moves, seconded by Councilmember Teeple to approve the February monthly Justice Court Report.  All in favor of this motion.

Dog Kennel Inspection Report: Councilmember Buisch moves, seconded by Councilmember Teeple to approve the inspection report on the dog kennel.

  

Councilmember Buckalew

Assessment:  Assessor Roach discussed the matter brought up in executive session in the February Board meeting, at the County level and feels comfortable with the information received.

The Assessment Department needs a new camera.

Commenting on Mr. Schaufelberger's situation, he didn't wish to appear insensitive, understanding Mr. Schaufelberger had reason to be upset.  Assessor Roach reiterated his position regarding signing documents.

Buildings: The church plans on taking the shed to the north of the church down.

  

Councilmember Buisch

Planning Board: Councilmember Buisch moved, seconded by Councilmember Teeple to receive and file the Planning Board minutes of February 6, 2012.  Motion carried.

Zoning Board: There was no Zoning Board meeting for February.

Receive & File Building Inspector's Monthly Fee Reports: Councilmember Buisch moved, seconded by Councilmember Teeple to receive and file the Building Inspector's February monthly fee report.  Motion carried. 

Building Inspector Report:

•·         Roger has attended the FLBOA Conference and completed his hours needed for certification.

•·         Wilson Street property has been cleaned up considerably; Roger is doing an inspection tomorrow.

Councilmember Teeple inquired about the red signs on buildings throughout the Town:  Roger explained that they alert the fire department on the conditions inside the building.  X (worst case, conditions inside unknown)

RESOLUTION #40-2012

Septic Inspector's Training

On motion of Councilmember Teeple, seconded by Councilmember Buisch the following resolution was ADOPTED - AYES 4 NAYS 0.

            RESOLVED, to send septic inspectors Don Sipes and Cooper Buckalew to training for septic inspectors and pay for the mileage.

        

RESOLUTION #41-2012

Storm Water Managing Training

On motion of Councilmember Buckalew, seconded by Councilmember Buisch the following resolution was ADOPTED - AYES 4 NAYS 0.

            RESOLVED, to approve Roger to attend DEC FEMA Training May 1-3, 2012 for a total to not exceed $775.00.

  

Supervisor Crane

Town Clerk's Monthly Report: Councilmember Teeple moved, seconded by Councilmember Buisch to approve the February 2012 monthly report of the Town Clerk.  Motion carried.

Town Board Meeting Minutes: Councilmember Teeple moved, seconded by Councilmember Buisch to approve the February 21, 2012 regular meeting minutes and the February 8, 2012 Special Meeting minutes. Motion carried.

Supervisor's Report: Councilmember Buisch moved, seconded by Councilmember Teeple to receive and file the Supervisor's report for February.  Motion carried.

Supervisor reported on the following: 

1.     Supervisor Crane received a letter from Cornell in regards to creating healthy places.  

2.     Councilmember Buisch commented that he would like to see Huron used as our mailing address instead of Wolcott.  He is going to test delivery of mail to Huron 14590.

3.     The Department of State has accepted the Sodus Point LWRP.

4.     Supervisor Crane received the results of the 2011 Census on Sodus Point Park.

5.     Supervisor Crane received a letter from Jason Monroe (WCWSA).

6.     Five Residents have paid their liens for the CDBG and will need a release.

7.     Mary Hunter property has been turned over to a new homeowner and the lien is still there. Attorney Kanyuck will discuss this with Attorney Knauf.

8.     Supervisor Crane doesn't believe the Trail at the end of Dutch Street is correct.

9.     Committee has been formed at the County Level to deal with the Lake Ontario water levels.

10.  Discussion on Sewer Districts with the Town and Village of Wolcott and WCWSA.  It was generally agreed that there would be strong resistance to creating sewer districts in light of the significant investment in advanced septic systems many residents have had to make under the Town's septic law; and a general feeling that the issue could be resolved by the adoption of a septic law in the Town of Wolcott.

           

            Attorney Kanyuck

            Building Addition:  This should be done by the end of the month to go out to bid.

            Lasher Road Property:   Roger's recourse is through the builder/engineer.

            Nixon Property:   There is a provision in the Navigation Law for access to properties.

            Property Damage to Basement: This has gone through Syracuse Constructors insurance; we will notify our insurance carrier of a potential claim.

            Carolina Avenue Property:   Roger has this on his to do list.
