Call to Order

Regular Meeting of the Huron Town Board was called to order by Supervisor Laurie Crane at the Huron Town Hall on July 16, 2012, at 7:00 p.m.

Roll Call

Upon roll call the following members were present: Supervisor Laurie Crane, Councilmember's Alan Traister, Russell Teeple, Lois Buckalew and David Buisch.

  

Welcome

Supervisor Crane welcomed everyone.

  

Public Participation

Alan Isselhard of North Huron Road addressed the Board concerning a female yellow lab that appeared at their house on the 4th of July. They took it to the vet to be checked; the dog is in good condition; checked for an identifying chip but none was found.  Flyers have been put up in the area; area animal control officers have been contacted.  Should anyone have information please contact Mr. and Mrs. Isselhard.

  

Correspondence

      

1.     Two letters from State of NY Dept. of Transportation regarding qualifications of road signs.

2.     A letter from Assessor David Roach requesting a pay increase for his clerk.

3.     A thank you letter from Project Graduation from the Project Graduation committee.

4.     A letter from Lee Walter reporting his findings in the 2011 audit.

5.     A letter from NY State Dept of Environmental Conservation discussing an evaluation of NY's coastal resiliency.

6.     A letter from NY Municipal Insurance Reciprocal included a Subscriber Accounting Statement for fiscal year 2011.

      

Discussion of Correspondence

#2 Councilmember Traister inquired if there was a pay scale for the Assessor Clerk; it was confirmed there is, therefore no action by the Board is needed.

      

Nancy Kasper

Nancy Kasper addressed the Board concerning the issue of hydrofracking, requesting the Board pass a resolution establishing a moratorium on hydro-fracking in the Town of Huron.  The greatest concern, as expressed by Ms. Kasper, is the contamination of the aquifer or water sources by the introduction of over 600 highly toxic chemicals used in hydrofracking.   She gave examples of the danger and an overview of the process.  According to Ms. Kasper there is an area in Wayne County being prepared for hydrofracking, where wells have been horizontally drilled a mile out in each direction, with a source of public water within a mile of the site.  Following complaints in Wyoming, the EPA drilled their own well to test the water and found contamination.   Nancy gave each Board member an information packet and suggested that  Board members could also inform themselves by accessing information on the internet.

Supervisor Crane had received an email from Susan Gately expressing her concerns and information about hydrofracking.  Supervisor Crane thanked Nancy Kasper for the presentation; Councilmember Buckalew suggested the Board be given time to digest the information before making a decision regarding a moritorium.  Ms. Kasper informed the board that she could give a power point presentation at a later date if desired, thanking the Board for their time.  The hydrofracking issue will be placed on the August 20, 2012, agenda.

      

Kris Kellogg

Kris Kellogg of Colonial Paul Revere, located in Weedsport, made a presentation offering her services as a broker for employee health and welfare benefits, at no charge to the Town.  As an example, if Ms. Kellogg were contracted by the Town as Broker of Record, at renewal time for health insurance, she would provide comparisons of health insurance coverage and costs, to assist the Town in making proper decisions.   She would also review the current employee benefits offered by the Town and make recommendations to enhance them or make them more cost effective.  In response to Supervisor Crane's inquiry as to how she is compensated for her services, she replied that she receives a commission from the various carriers providing the coverage.  Ms. Kellogg provided the Board members with an information packet requesting their consideration.  The Board indicated it would take the matter under advisement, agreeing to place the matter on the August meeting agenda.

On motion of Councilmember Buckalew, seconded by Councilmember Buisch the following resolution was ADOPTED- AYES 5 NAYS 0.

BE IT RESOLVED, that the Town of Huron hereby establishes the following as standard work days for elected and appointed officials and will report the following days worked to the New York State and Local Employees' Retirement System based on the record of activities maintained and submitted by these officials to the Clerk of this body:

Memory of William Galvin

Supervisor Crane read a resolution in memory of William Galvin whom served the Town from 1982-1983 and 1986-1989, this resolution will be included in the July 16, 2012 regular meeting minutes and a copy will be presented to the family of William Galvin.

      

Local Law #4 of 2012 Public Hearing

The Town Clerk would like to proceed with annual dog licensing June 30th of each year. Fees will be prorated for dog licenses issued after the effective date of the local law and before the June 30th following, to bring them into the normal renewal cycle.  The public hearing will be held August 20, 2012 at 7:30 p.m.

      

Water District #6 Construction Observation Svs.

Supervisor Crane received a letter from MRB explaining that the observation services for Water District No. 6 have exceeded the budgeted amount.  Water District #6 was an extremely difficult and complicated project due to wetland issues, the number of private roads and other issues. A budget modification request is forthcoming.

      

DEC Training

Town Clerk Vezzose, Deputy Clerk Sipes and Mr. and Mrs. Davenport of Davenport's Bait Shop satisfactorily completed mandatory training on issuing hunting and fishing licenses. The training involved 4 and a half hours of instruction followed by a test.  Issuance of Licenses will begin August 13, 2012,this year.

      

Master Plan Public Hearing

Councilmember Buisch moved, seconded by Councilmember Teeple to hold a public hearing on the master plan on September 17, 2012 at 7:30 p.m. All in favor of this motion.

      

Any Other Business

      

  • Proposed Water District #8: Supervisor Crane will get the number of homes this district would serve from Assessor Roach and the miles from Highway Superintendent Reyn.
  • Councilmember Buisch presented the Town Board with a school roster published in 1919 from Huron School District No. 2 donated by Jennie Sedore of 8581 York Settlement Road Sodus found amongst her grandmother Amelia Seymour's belongings.

      

Committee Reports

       

Councilmember Teeple:

Highway: Superintendent Reyn reported that everything is running smoothly. They have started the construction project on Lummisville Road.

  

Councilmember Traister:

Historian: Councilmember Traister read the report of the Historian.

Justice: Councilmember Traister moved, seconded by Councilmember Teeple to receive and file the June 2012 justice court report.

LWRP: Councilmember Traister reported a public informational meeting will be held on July 26, 2012 at 7:00 p.m. He also read the report from Barbara Johnston (Consultant on LWRP) on the progress.

RESOLUTION #93-2012

Trees limbs Over Grange Roof

On motion of Councilmember Buckalew, seconded by Councilmember Teeple the following resolution was ADOPTED- AYES 4 NAYS 0 ABSTAINED 1. Supervisor Crane abstained.

            RESOLVED, to allow Robert Crane to remove the limbs over the Grange roof at a cost to not exceed $50.00.

Councilmember Buckalew:

Old Town Hall: There is dead ivy which needs to be removed, and the back of the building needs paint.

       

Councilmember Buisch:

Receive & File Building Inspector's Monthly Fee Report: Councilmember Buisch moved, seconded by Councilmember Teeple to receive and file the Building Inspector's June monthly report. Motion carried.

Planning Board Minutes: Councilmember Buisch moved, seconded by Councilmember Traister to receive and file the June 4, 2012 Planning Board minutes. Motion carried.

Zoning Board Minutes: Councilmember Buisch moved, seconded by Councilmember Teeple to receive and file the June 12, 2012 Zoning Board minutes. Motion carried.

Clerk to Planning and Zoning Applicants: There were 7 applications received for this postion; Councilmember Buisch will review them and contact the applicants meeting the requirements to attend the next Zoning Board meeting to conduct minutes.

Building Inspector Report:

DEC has announced the extension of open fire outside burning restrictions to October 11, 2012. This includes all yard waste. There will be strong enforcement and fines for violations.  Violations can be reported by calling 911.

  

Councilmember Buisch inquired of Attorney Knauf if there is anything the Town Board can do with respect to decisions taken by the Zoning Board of Appeals; understanding that they function independently from the Town Board.  He cited a recent decision denying a request, although it was recommended by the County Planning Department, County Highway Department, and the ZBA Chairman; that in his opinion approval would have been in the Town's interest and enhance the property in question.  Attorney Knauf said no, apart from requesting that the ZBA rehear the case; that otherwise the only influence the Town Board can exercise is in the appointment of the Board members.

      

Supervisor Crane:

Town Clerk's Monthly Report: Councilmember Buisch moved, seconded by Councilmember Traister to approve the June monthly report of the Town Clerk. Motion carried.

Town Board Meeting Minutes: Councilmember Buisch moved, seconded by Councilmember Teeple to approve the June 18, 2012 Regular meeting minutes with the following corrections:

Resolution #78-2012 change to read: The Town of Huron will reject MRB's Strategic Plan for Water Districts, allowing for one fee of $15,000.00 to be paid for the start of all water districts. The Town of Huron will continue to pay preliminary engineering costs for each future project.   Assessor David Roach will provide a list of residences on the roads in proposed District #8 to assist the Board in a predetermination of its economic feasibility.

Resolution #88-2012 to read: ADOPTED- AYES 4 NAYS 0. General $25,080.41 Highway $99,044.42 TA $445.52.

Resolution #81-2012 to read: CDU Charge for SW Accounts: SWC (1380.4) $100.00 and SWD (1380.4) $100.00 for Fiscal Agent Fees. Councilmember Buckalew abstained. Motion carried.

County Issues:

Local Law to create Dept. of Emergency Management Svs.  This move will combine Wayne County Office of Emergency Medical Services, Wayne County Office of Fire Coordinator, Wayne County Office of Emergency Management, Wayne County Office of E911 and Wayne County Office of Advanced Life Support Services under one department head. There will be a Public Hearing at 7:00 p.m. on Tuesday.

Local Law to create Dept. of Public Works.  On Monday August 13, 2012 at 10:15 a.m. the board will be setting a date for Public Hearing for proposed Local Law and creating a Dept. of Public Works which will dissolve the Wayne County Highway Department and the Wayne County Department of Buildings and Grounds.

Letter from Wolcott Fire Dept.  soliciting  donations. (The board feels that a donation from the Town in addition to the taxes they receive, is not necessary).

Trailworks Meeting. There will be a meeting on August 21, 2012 at 7:00 p.m. at the Huron Town Hall for Trailworks at the end of Dutch Street (Whistlewood Trail).

Attended the SBIA picnic and spoke on Plan BB7.

Domestic Animal Abuse Law is being considered providing for online registry of persons upon conviction of an Animal Abuse offence; and fine of $100.00.

Wayne County Fair will be held August 13-18, 2012.

Yellow Dot Program: The Wayne County Sheriff's Office is working on this program which gives a person two yellow forms and two yellow stickers.  The forms record personal emergency information; one form to be placed in the glove compartment of one's vehicle, the sticker placed on the windshield.  The other form to be placed in a plastic bag in one's freezer, the sticker placed beside the front door.

      

Phone System

Councilmember Traister inquired about the progress with the Town telephone system.  Supervisor Crane responded that she has met with a new representative from Time Warner and will call again tomorrow.

      

5 Year Planning

Account Clerk Hamilton informed the board that she and Supervisor Crane will be attending a workshop on 5 year plan decision making Wednesday, August 18th.

RESOLUTION #94-2012

Budget Transfer

On motion of Councilmember Buckalew, seconded by Councilmember Buisch the following resolution was ADOPTED- AYES 5 NAYS 0.

            RESOLVED, to approve the following budget transfer.

From 5130200DA (Machinery Equipment) to 5130400DA (Machinery) $3,210.00 and the residual amount of $623.92 to be moved from 5130400DA (Machinery) to 5130200DA (Machinery Equipment).
