Call to Order

Regular Meeting of the Huron Town Board was called to order by Supervisor Laurie Crane at the Huron Town Hall on March 18, 2013, at 7:00 p.m.

  

Flag Salute

Supervisor Crane led the flag salute.

  

Roll Call

Upon roll call the following members were present: Supervisor Laurie Crane, Councilmembers David Buisch, Russell Teeple, Lois Buckalew and Councilmember Alan Traister.

Supervisor Crane welcomed everyone.

  

Announcements

Public Hearing for Local Law #1 of 2013 (Amend the Town of Huron Septic Law Regarding Alternative Septic Systems, Gray Water and Inspection Criteria) 7:30 p.m.

   

Public Participation

Supervisor Crane asked if there was anyone from the public that wished to speak.

  

 

Correspondence

The following correspondence was received and filed:

1. A letter from Skippers Landing Restaurant notifying the Town Clerk their intent to renew their seasonal liquor license for 2013 for Inside.

2. A letter from Skippers Landing Restaurant notifying the Town Clerk their intent to renew their seasonal liquor license for 2013 for Outside Deck.

3. An email in regards to Ginna Training Drill on March 14, 2013 and April 10, 2013.

4. A letter from Wayne County Planning Department confirming training completed by Charles Boogaard and Larry Lockwood: Training held on March 6, 2013 for Planning Board Basics.

Discussion of Correspondence

#3 Councilmember Buckalew was prepared to represent the Town in the absence of Supervisor Crane, but received the email from the Town Clerk advising the Ginna Training Drill was for Supervisors only.

   

Building Department Escrow Accounts

Councilmembers Teeple and Buckalew did not find the proposed language amending Section 50.24 of the Zoning Law, acceptable.  Following the Board discussion with Building Inspector Gallant, Councilmember Buisch offered to draft new language dealing with the matter for the April 15, 2013 Town Board Meeting.

    

Bereavement Leave

Councilmember Teeple moved, seconded by Councilmember Buckalew to accept the bereavement leave policy as drafted by Councilmember Buisch.  The policy to be incorporated in the Employee Handbook, reads:

Bereavement Leave

  

As a regular full time employee you may be granted bereavement leave with pay as indicated below.

  

Three (3) days for immediate family members:

  • Spouse
  • Children
  • Father or Step-Father
  • Mother or Step-Mother
  • Sister and Brother
  • Step-brother and Sister (when the relationship was established during your formative years).

  

Two (2) days for:

  • Father and Mother of your Spouse
  • Sister and Brother of your Spouse

  

One (1) day for:

  • Grandfather and Grandmother

  

For instances of bereavement not covered herein, time off may be granted and charged against your PTO or treated as unpaid leave.

    

Recycle of Electronics by E-Scrap for Camp

Supervisor Crane has yet to check on the availability of a container.

  

Audio and Recording Equipment

The Board deferred a decision regarding installation of audio and recording equipment in the meeting hall until later in the year.  Councilmember Buckalew recommended the Board not take money from contingency at this time.  Issue tabled for future discussion.

  

2013 Wayne County Salary Comparison

Town Clerk presented the board with the 2013 Wayne County Salary Comparison.

  

Open Public Hearing on Local Law #1 of 2013

Supervisor Crane opened the public hearing at 7:30 pm.   

Comments from the Public, (owners of property on Crescent Beach, the area most immediately affected by the law):

Q:  C. J. Postich - When does the clock start?

A:  David Doyle (MRB Group) & Roger Gallant - Every site will be subject to inspection; inspections to start in the summer.  Notification letters will be sent out.

  

David McNair:  Residents have done all possible to cooperate with the Town/Building Inspector to arrive at an acceptable solution to the septic issue on the sand bar.

  

Q:  Sue Stevens - What has to be done?

A:  David Doyle (MRB Group) & Roger Gallant - Assuming the system fails inspection, the property owner will be given two years to comply with the Law;  it's hard to imagine any conventional system passing.

    

General comments - David Doyle (MRB Group) & Roger Gallant: With respect to gray water, the law requires that all discharge water must go into a septic system.  There are 5 aerobic systems currently operating on Crescent Beach.  Most
manufacturers check the system at least twice per year.  The property owner should check with the service provider if systems will be shut down during the winter months.  To the question "can systems be shared?" the answer is yes; the property owners concerned would be responsible to have legal agreements in place.

  

David Scudder:  Based on his experience, the initial Service Contract on an aerobic system provides 2 years of inspections; after that the cost for annual servicing is roughly $300 per year.

  

Close Public Hearing 

Supervisor Crane closed the public hearing at 7:58 p.m. Attorney Kanyuck went through the SEQR and Negative Declaration.

  

RESOLUTION #52-2013

Environmental Assessment Form

On motion of Councilmember Teeple, seconded by Councilmember Buisch the following resolution was ADOPTED - AYES 5 NAYS.  

            RESOLVED,

WHEREAS, Proposed Local Law No. 1 of 2013 (the "Local Law") would amend the Town of Huron Septic Law, as amended, to address and allow the installation of aerobic systems, enhanced treatment units and other alternative septic system(s) in sensitive and difficult areas in order to reduce pollution and protect water quality, and addresses gray water; and  

            WHEREAS, the Local Law has been on the desks of all Town Board since March 11, 2013; and  

            WHEREAS, an Environmental Assessment Form ("EAF") was prepared for the Local Law, which the Town Board has reviewed; and  

            WHEREAS, Notice of a Public Hearing on the Local Law was published in the Times of Wayne County on March 12, 2013, and the Town Clerk also caused a copy of that Notice to be posted on the sign board of the Town maintained pursuant to Town Law §30(6) on March 11, 2013 and on the Town of Huron website (along with the proposed text of the law) on March 11, 2013; and 

            WHEREAS, some minor technical corrections have been made to the Local Law originally circulated; and  

            WHEREAS, a public hearing was duly held on the Local Law on March 18, 2013 at 7:30 PM before the Town Board at the Huron Town Hall, and all persons desiring to speak were heard; and  

            NOW THEREFORE, IT IS RESOLVED, that the Town Board has considered the Local Law and its potential for environmental impacts; reviewed and considered the EAF, the criteria contained in 6 N.Y.C.R.R. §617.7(c), and other supporting information to identify the relevant areas of environmental concern; and thoroughly analyzed the identified relevant areas of environmental concern to determine if the Local Law may have a significant adverse impact on the environment, and finds that the Local Law would not have a significant impact on the environment, because:  

1.       The Local Law would provide for the installation of aerobic systems and other alternative septic system(s) in sensitive and difficult areas in order to reduce pollution and protect water quality.  

2.       The Local Law would clarify and amend the current Septic Law to allow such systems on Crescent Beach, which poses unique physical conditions, being sand bordered on the north by Lake Ontario and the south by Sodus Bay, and also being located in a Coastal Erosion Hazard area.  These conditions make installation, maintenance and use of conventional septic systems difficult or impractical, and also make typical septic inspections more difficult or not reliable.   Other areas of the Town may also have unique conditions. 

3.       The Town has investigated alternative septic systems that would be acceptable to the New York State and minimize pollution, as well as alternative methods of septic inspection, that would be suitable for Crescent Beach and other areas of
the Town which may also pose problems for traditional septic systems, and findsan aerobic system or other alternative septic system approved by the New York State Department of Health would be more protective of health and the environment than traditional systems on Crescent Beach, and possibly other areas of the Town.
 

4.       The Local Law will also regulate gray water systems, improve inspection criteria, and ensure that systems comply with the Town of Huron Coastal Erosion Hazard Area Law. 

5.       Accordingly, the Local Law will prevent the introduction of pollution into the Town's coastal areas, thereby providing greater protection of water quality, fish, aquatic vegetation, natural resources and other facets of the environment in
the Town.
 

6.       Further, the Local Law would improve neighborhood character, and have a beneficial cumulative impact, by assuring that the waterways in the vicinity of residential uses are free from pollution resulting from inadequate septic
systems, thereby improving recreational uses and property values.
 

7.       The Local Law would not result in any identified negative environmental impacts or induce other actions, and is consistent with the Master Plan of the Town.

      IT IS FURTHER RESOLVED, that pursuant to the State Environmental Quality Review Act, a Negative Declaration shall be made and duly filed, and an environmental impact statement need not be prepared; and it is  

FURTHER RESOLVED that, pursuant to the Municipal Home Rule Law, Proposed Local Law No. 1 of 2013 is hereby enacted, and shall be filed with the Secretary of State.

   

NYS Brush Burning BAN

DEC has issued a ban on burning brush from March 16- May 14, 2013. This is also on the Town of Huron Webpage.

Committee Reports     

Councilmember Teeple 

Water Districts: Water District #5 Pump Station, the 2nd meeting will be on Friday. Water District #8 is a project that can be done; the income surveys may make a difference. 

Highway Department: Teeple advised the Highway Department is working on the Slaght Road Bridge.  Applications to fill the position vacated by Steve Connelly are being reviewed. Councilmember Buisch inquired if an exit interview was conducted for Steve Connelly; Councilmember Teeple responded that this has not been done in the past but could be done in the future.
 

Councilmember Traister

Historian Report: Councilmember Traister moved, seconded by Councilmember Teeple to approve the Historians February Report. Motion carried. 

Justice Monthly Report: Councilmember
Traister moves, seconded by Councilmember Teeple to approve the February monthly Justice court report. All in favor of this motion.
 

Animal Control Monthly Report: Councilmember
Traister moves, seconded by Councilmember Buisch to approve the February Animal Control Monthly Report.

   

Councilmember Buckalew 

Assessment:  Nothing new to report. 

Insurance: The increase is less than 4%. 

Buildings: Supervisor Crane has not had a chance to talk with Historian Powell.
 

Councilmember Buisch 

Planning Board: Councilmember Buisch moved, seconded by Councilmember Traister to receive and file the Planning Board minutes of February 4, 2013. Motion carried. 

Zoning Board: Councilmember Buisch moved, seconded by Councilmember Teeple to receive and file the Zoning Board minutes of February 12, 2013. Motion carried.  

Receive & File Building Inspector's Monthly Fee Reports: Councilmember Buisch moved, seconded by Councilmember Teeple to receive and file the Building Inspector's February monthly fee report.  Motion carried.  

Building Inspector Report:        
Roger thanked the Board for passing the Septic Law; the Board also thanked Dave Doyle. 

Building Inspector Office HoursBuilding Inspector Gallant advised the Board that he cannot maintain regular office hours and remain effective.  He needs the flexibility to be out in the field.  Appointments can be made by phone - his cell phone is published and he is available by phone at any time.  Discussion followed concerning the Clerk to Building Inspector.  Some Board members would like to see a clerk available during daytime hours.  Roger reminded the Board of what he would be
losing if his current clerk were to be replaced at this time:  There being no ready solution, the matter remains open.  Councilmember Buisch moved, seconded by Councilmember Teeple to discontinue office hours for the Building Inspector and publish availability by appointment. Motion carried.

    

Supervisor Crane 

Town Clerk's Monthly Report: Councilmember Buisch moved, seconded by Councilmember Traister to approve the February 2013 monthly report of the Town Clerk. Motion carried. 

Tax Collector Collection Summary: Councilmember Buisch moved, seconded by Councilmember Buckalew to receive and file the Tax Collector Collection Summary. All in favor of this motion. 

Town Board Meeting Minutes:

Councilmember Buisch moved, seconded by Councilmember Buckalew to approve the February 5, 2013 regular meeting minutes with the following correction of the Resolution Numbers: 

Resolution #32-2013 to approve the proposal for Professional Engineering Services to Slaght Road East Bay Creek Crossing Bridge; 

Resolution #33-2013 to calculate amount incorrectly withheld from paycheck of Steven Connelly to be reimbursed through payroll.  Motion carried. Councilmember Teeple abstained.

    

Councilmember Teeple moved, seconded by Councilmember Buisch to approve the February 19, 2013 regular meeting minutes with the following corrections:  Add March 31, 2013 as Justice Blauvelt's effective date of retirement; 

Resolution #36-2013 add April 23-25, 2013 as date of Conference; 

Resolution #37-2013 add April 28-May 1, 2013 as date of Conference; 

Resolution #41-2013 add March 18-21, 2013 as date of Conference.  Motion carried.

    

Councilmember Traister moved, seconded by Councilmember Teeple to approve the March 5, 2013 regular meeting minutes with the following correction: Add March 10, 2013, Steven Connelly's effective date of resignation. Motion carried.

     

Supervisor's Report: Councilmember Buisch moved, seconded by Councilmember Traister to receive and file the Supervisor's report for February.  Motion carried. 

Supervisor reported on the following: 

1.    The Health and Medical Committee issued an RFP for Food and Housekeeping services at the Wayne County Nursing Home while Supervisor Crane was on vacation.

   

Attorney Kanyuck  

            Aquatic Weed District: Attorney Kanyuck advised the Town has go out for bids on weed harvesting for the District before awarding the contract to SBIA. Attorney Kanyuck also advised that the size of the District cannot be reduced: The District can be eliminated entirely, but only by special legislation.  David Scudder has spoken with Bill Sarver to get more involved with the district.

 

RESOLUTION #53-2012 

            Advertise for Aquatic Weed 

            On motion of Councilmember Buisch, seconded by Councilmember Buckalew the following resolution was ADOPTED - AYES 5 NAYS 0.  

                        RESOLVED, to advertise for weed harvesting in the Aquatic Weed District in the next addition of the Times of Wayne County.

RESOLUTION #55-2013 

Water #5 Legal Services

On motion of Councilmember Teeple, seconded by Councilmember Buckalew the following resolution was ADOPTED - AYES 5 - NAYS 0.  

            RESOLVED, to increase the dollar limit in the contract for legal services for Town of Huron Water District #5 by $3,000.00. This increase is due to additional services that have been required with respect to the North Geneva Road Pumping
Station, including review of contracts and additional title review.
