Call to Order
Regular Meeting of the Huron Town Board was called to order by Supervisor Philip Eygnor at the Huron Town Hall on June 15, 2020 at 6:00 pm.

Flag Salute was led by Supervisor Eygnor.
Roll Call
Upon roll call the following members were present: Supervisor Philip Eygnor, Councilmembers’ Bob Cahoon and Richard Reyn. Councilmember David Buisch and Russell Teeple were absent.

Correspondence
Fowler’s Marina Sale to DEC
The Town granted Fowlers the right to sell Fowler's Marina to the DEC. Councilmember Cahoon asked if that right to sell to the DEC goes with the property, should Fowlers sell the property to someone else. Attorney Kendall will review the matter.

Committee Reports
Councilmember Teeple
Water: In Limbo right now.
Port Bay Sewers: Moving along.
Highway: Highway Superintendent Reyn reported that they have been hauling stone. He received the letter on CHIPS and funds could be cut up to 20%; he will have a clearer picture after submissions in September or October.
Councilmember Cahoon
Spring Clean Up: Councilmember Cahoon reported that Clean Up day went very well. It was nice to have 2 loaders going as it made things run smoothly. The handing out of face masks worked very well.
Open and Close Public Hearing for Proposed Local Law #1 of 2020
Supervisor Eygnor opened the Public Hearing for proposed Local Law #1 of 2020 - Sewer Law at 6:10 p.m. Attorney Kendall explained the need for the Public Hearing and Local Law; The Short Form, environmental assessment form for the negative declaration was reviewed; DEC filed a positive environmental impact and there was no public comment. Councilmember Reyn moved, seconded by Councilmember Cahoon to close the public hearing at 6:21 p.m.
Open and Close Public Hearing for Proposed Local Law #2 of 2020
Supervisor Eygnor opened the Public Hearing for Local Law #2 of 2020 - Best Value Law at 6:21 p.m. Attorney Kendall explained the need for the Public Hearing and Local Law which give the option to look at other criteria and there was no public comment. Councilmember Reyn moved, seconded by Councilmember Cahoon to close the public hearing at 6:24 p.m.

Receive and File Building Inspector Monthly Fee Reports: Councilmember Reyn moved, seconded by Councilmember Cahoon to receive and file the April and May Building Inspector Monthly Fee Reports. Motion carried.
Siding of Main Shop: Highway Superintendent Reyn has contacted Jay Eygnor.

Town Clerk Monthly Report: Supervisor Eygnor moved, seconded by Councilmember Reyn to approve the April and May 2020 monthly report of the Town Clerk.
Town Board Meeting Minutes: Supervisor Eygnor moved, seconded by Councilmember Cahoon to approve the May 21, 2020 Regular Meeting Minutes. Motion Carried.

Open and Close Public Hearing for Proposed Local Law #3 of 2020
Supervisor Eygnor opened the Public Hearing for proposed Local Law #3 of 2020 - Zoning Law at 6:31 p.m. Attorney Kendall explained the need for the Public Hearing and Local Law which allows people to work from home and defines the difference between a home occupation ng from home or a business; Any variance will go through Zoning Board of Appeals, there is no significant environmental impact. This was referred to County Planning which had some recommendations however Planning responded that this is a local matter and up to the Town. There was public comment:
Rebekah Hoefling: 6341 Anchors Way, had a question relating to persons working for a business from their home. A: Section (4) provides for a person working for a business from their home.
Councilmember Reyn moved, seconded by Councilmember Cahoon to close the public hearing at 6:37 p.m.
Open and Close Public Hearing for WCWSA Lease Addendum #2
Supervisor Eygnor opened the Public Hearing for WCWSA Lease Addendum #2 at 6:40 p.m. Attorney Kendall explained the need for the Public Hearing which is maintaining the contract the Town has with WCWSA to provide water. The purpose is the construction of a Regional Tank: The addendum would match the agreement with the bonding for construction of Regional Tank over 40 years. The end dates need to match which means extending the lease term to 12/31/2060, which extends it out 2 years. There was no public comment. Councilmember Reyn moved, seconded by Councilmember Cahoon to close the public hearing at 6:41 p.m.

Proposed Local Law No. 4
Attorney Kendall commented on Proposed Local Law #4 of 2020 and explained that this proposed law would be opened tonight and accepts comments from the public but would not be adopted tonight due to the need for this to go to County Planning. The public hearing will remain open until the Town hears back from County Planning. Basically proposed Local Law #4 is based on NY Town Law which provides Towns with the ability to enact an incentive zoning law which gives the Town Board the authority to work with a developer if the developer provides an incentive; and that can be anything. An example: a hiking trail, a financial donation to an upkeep of a public park, sidewalks, sewer, etc.. It provides the Town Board to holistically look at the project and agree to variances of its zoning laws in exchange for incentives. Towns throughout all of NYS have this law. It’s a good tool; it is not something that would come up often as it is in line with developments.
Open and Public Hearing for Proposed Local Law #4 of 2020
Councilmember Reyn moved, seconded by Councilmember Cahoon to open the Public Hearing for Proposed Local Law #4 of 2020 - Incentive Zoning Law at 6:52 p.m. and there was public comment:
Councilmember Cahoon: This is project by project. A: Yes. First a developer comes to the Town Board with a plan, if the Town Board agrees with the plan, it then goes to Planning Board. The recommendation from the Planning Board would then come back to the Town Board for a determination. The Town Board and Planning Board would work together.
Alan Isselhard: 8135 North Huron Road, expressing opposition. We don’t appreciate Local Law #4 and we feel it was not properly published as it was never entered on the Town of Huron website in a detailed document, as was stated it would be in the legal ad. Because the law was not properly and legally published the law should not be voted on tonight and I don’t think it will be by the Town Board. Since we did not get detail on Local Law #4 until this afternoon we cannot comment appropriately on it at this time. But we do feel that incentive zoning is kind of a sneaky means of bringing in a questionable project that benefits only a select group of persons or business and we think this is disgusting and we think this kind of makes ethics questionable. And that is our opinion at this point in time. When will this be submitted to the Wayne County Planning Board. A: It will be submitted this week.
Mary Isselhard: 8135 North Huron Road. It’s premature to submit this to the County Planning Board as we said, this meeting was not properly published. You said in the legal ad that it can be brought up on the Town website in detail, the document was not attached; I brought this to Tammy’s attention about 4:30 today. We have not had adequate time to review this and we will have many comments. You need to go back right to point zero and publish this in the papers properly.
